Terms of Service (TOS)

1. Scope

These Terms of Service (hereinafter "TOS") apply to all agreements concerning the use of the digital content and services of RegainLove, concluded between Growthpaca GmbH, Blankenburger Str. 67, 13156 Berlin, Germany (hereinafter "Provider") and the customer (hereinafter "User").

2. Subject Matter

The Provider offers a digital 30-Day Program on the website regainlove.com that helps Users improve or restore their relationship. The program includes:

  • Access to a structured 30-Day Program with daily lessons
  • Personalized content based on an initial quiz
  • Progress tracking and resources
  • Access to all program content for a minimum of 6 months after purchase

3. Formation of Contract

The contract is formed in the following steps:

  1. The User completes the quiz on the website
  2. The User registers with an email address and password
  3. The User accepts these TOS by ticking the checkbox
  4. The User is redirected to the Paddle Checkout page
  5. After successful payment, the User receives immediate access to the program

The contract is concluded upon successful payment. The User will receive a confirmation email.

4. Prices and Payment Terms

Current prices are shown on the website and may vary by location. For US customers, prices are displayed in USD and applicable sales tax may be calculated at checkout based on your shipping or billing address.

This is a one-time payment. There is no subscription and no recurring charges.

Payment is processed via Paddle.com Market Limited as Merchant of Record. Paddle acts as the official seller and handles all payment processing and tax compliance. The Paddle Terms apply.

5. Refund Policy

We want you to be happy with RegainLove. If you are not satisfied with our service, you can request a full refund within 14 days of your purchase - no questions asked. Simply send us an email at [email protected] and we will process your refund.

Refunds are handled by Paddle.com Market Limited as the Merchant of Record.

6. Usage Rights and Obligations

6.1 Granted Rights

The User receives a simple, non-transferable, non-sublicensable right to use the program content for personal, non-commercial purposes.

6.2 Prohibited Activities

The User is particularly prohibited from:

  • Reproducing, distributing, or making the content publicly available
  • Sharing the content with third parties
  • Sharing login credentials with third parties
  • Commercially exploiting or selling the content
  • Circumventing technical protection measures

6.3 Account Security

The User must keep their login credentials confidential and protect them against unauthorized access. If unauthorized access is suspected, the User must inform the Provider without delay.

7. Availability and Technical Requirements

The Provider strives for high availability of the platform, but a 100% uptime cannot be guaranteed. Maintenance work will be announced where possible.

Technical requirements:

  • Internet connection
  • Current web browser (Chrome, Firefox, Safari, Edge)
  • Cookies enabled (for login functionality)

8. Warranty and Liability

8.1 Warranty

Statutory warranty rights apply. The Provider warrants that the digital content is free from material and legal defects at the time it is made available.

8.2 Important Disclaimers

The Provider is not a licensed psychologist, therapist, or mental health professional. The program is intended for self-help and educational purposes only and does not replace professional psychological or therapeutic advice. If you are experiencing a mental health crisis, please contact a qualified professional.

Parts of the program content may be generated or assisted by artificial intelligence (AI). All content is reviewed for quality and accuracy.

8.3 Limitation of Liability

The Provider assumes no liability for:

  • The success of restoring a relationship
  • Individual results or outcomes
  • Emotional effects of the program content

The Provider is liable without limitation for damages resulting from injury to life, body, or health, and for damages caused by intent or gross negligence.

Otherwise, the Provider is liable only for breaches of material contractual obligations. In such cases, liability is limited to foreseeable, typical damages. Some jurisdictions do not allow limitations on implied warranties or the exclusion or limitation of certain damages, so the above limitations may not apply to you to the extent prohibited by law.

9. Privacy

The Provider collects and processes personal data of the User only in accordance with applicable laws. For details, please see the Privacy Policy.

10. Termination and Deletion

The User receives access to the program content for a minimum period of 6 months from the date of purchase. Access may continue beyond this period at the Provider's discretion, for as long as the platform remains operational. The Provider reserves the right to discontinue the platform with reasonable notice.

The User may request deletion of their account at any time. Deletion revokes access to the program content. Refunds are subject to the refund policy outlined in Section 5.

The Provider may terminate access for cause in the event of serious violations of these TOS, in particular in cases of:

  • Sharing login credentials with third parties
  • Commercial use or resale of the content
  • Infringement of copyrights

11. Changes to These TOS

The Provider may change these TOS with future effect where necessary and reasonable. Users will be informed of changes by email. If the User does not object within 4 weeks of notification, the amended TOS are deemed accepted.

12. Dispute Resolution

We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.

13. Governing Law and Venue

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods.

If the User is a consumer, this choice of law applies only to the extent that mandatory consumer protection provisions of the jurisdiction in which the User resides are not restricted.
